Terms of Service

1. About the Platform

Screening Services Mobile is an online marketplace that connects customers seeking specimen-collection and screening services (such as breath alcohol/BAT testing, drug testing, and blood collection) with independent third-party providers ("Collectors").

Screening Services Mobile is not a medical provider, laboratory, or testing facility, and does not perform collections, testing, or diagnoses. We do not employ Collectors. Collectors are independent businesses solely responsible for the services they provide.

2. Eligibility & Accounts

You must be at least 18 years old and able to form a binding contract to use the Platform. Customers may submit service requests without an account; certain features require registration.

Collectors must register, provide accurate business information and certifications, and maintain an active subscription to receive and be connected to customers. You are responsible for keeping your login credentials secure and for all activity under your account.

3. Collector Subscriptions & Billing

Collectors must agree to and maintain a recurring subscription (currently $10.99/month) to be matched with and receive customer requests. Access to customer leads is contingent on an active, paid subscription.

Fees are billed through our third-party payment processor (Stripe). Unless otherwise stated, fees are non-refundable except where required by law. If your subscription lapses or is cancelled, your profile will stop receiving customer requests.

4. Customer Requests & Connections

When a customer submits a request, Screening Services Mobile matches it to Collectors based on the requested services and the customer's ZIP code, and forwards the customer's name, contact information, and service details to those matched Collectors so they may contact the customer directly. Once this information has been transmitted to the matched Collectors, Screening Services Mobile's involvement in the connection ends.

Screening Services Mobile does not sell, rent, or trade your personal information, and does not share it with any third party other than the matched Collectors and the service providers that help us operate the Platform.

Screening Services Mobile does not guarantee that any Collector will respond, accept, or complete a request, nor the availability, quality, pricing, or outcome of any service.

5. Reviews

Customers may leave reviews only after confirming that a Collector contacted them. Reviews must be honest, based on a genuine experience, and must not contain unlawful, defamatory, or misleading content. We may remove reviews that violate these Terms.

6. Collector Representations

Collectors represent and warrant that they hold all licenses, certifications, registrations, and insurance required to lawfully provide their services, that all uploaded documents are accurate and current, and that they will comply with all applicable laws, including health, privacy, and chain-of-custody requirements.

7. Disclaimers

The Platform and all services are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Screening Services Mobile does not verify, endorse, or guarantee any Collector's credentials, conduct, or work, and is not a party to any agreement between customers and Collectors.

8. Limitation of Liability

To the maximum extent permitted by law, Screening Services Mobile and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Platform or any interaction with a Collector or customer. Our total liability will not exceed the greater of the amounts you paid to us in the twelve months before the claim or US $100.

9. Marketplace-Specific Limitation of Liability

The Application is an online marketplace, operated by Screening Services Mobile, LLC ("the Company"), that enables customers and independent contractors ("Service Providers") to connect and arrange services. The Company is not a provider of the services offered through the Application and does not employ, supervise, direct, control, or manage Service Providers.

To the fullest extent permitted by applicable law, the Company is not responsible for the quality, safety, legality, suitability, timeliness, completion, or outcome of any services performed by Service Providers, nor does the Company guarantee that any customer or Service Provider will fulfill their obligations.

The Company does not verify, endorse, or guarantee the accuracy, qualifications, certifications, licensing, insurance, identity, experience, or background of any user unless expressly stated within the Application. Any verification or background screening conducted by the Company is limited in scope and should not be relied upon as a guarantee of a user's character, qualifications, or future conduct.

Users are solely responsible for evaluating the suitability of any individual or business with whom they choose to interact through the Application.

To the fullest extent permitted by law, the Company shall not be liable for any injury, death, property damage, financial loss, lost profits, emotional distress, business interruption, data loss, fraud, theft, misconduct, negligence, criminal acts, contract disputes, or any other damages arising from or related to:

• Services requested, offered, or performed through the Application;

• Any act or omission of a customer, Service Provider, or other user;

• Communications or interactions between users, whether online or offline;

• Scheduling, cancellations, delays, pricing disputes, refunds, or payment disputes;

• Damage to property or personal belongings;

• Personal injury or accidents occurring before, during, or after the performance of services;

• Unauthorized access to accounts or transactions resulting from a user's failure to safeguard account credentials.

The Company is not a party to any agreement entered into between customers and Service Providers and assumes no responsibility for enforcing, interpreting, or resolving disputes arising from those agreements.

Any disputes regarding the quality, completion, pricing, cancellation, or performance of services are solely between the customer and the applicable Service Provider. While the Company may, at its sole discretion, assist in resolving disputes, it has no obligation to do so and any such assistance does not create liability or waive any rights under these Terms.

To the fullest extent permitted by applicable law, the Company's total aggregate liability arising out of or relating to the Application, these Terms, or any services arranged through the Application shall not exceed the greater of: (a) the total fees actually paid by you directly to the Company during the twelve (12) months immediately preceding the event giving rise to the claim; or (b) one hundred U.S. dollars (US $100), if no fees were paid.

These limitations apply regardless of the legal theory asserted, including contract, tort (including negligence), strict liability, statute, or otherwise, and apply even if any limited remedy fails of its essential purpose or the Company has been advised of the possibility of such damages.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

10. Governing Law & Venue

Disputes between a customer and a Service Provider (Collector) arising out of services requested, offered, or performed through the Platform are governed by the laws of the U.S. state in which the applicable Service Provider is located.

These Terms, and any dispute involving Screening Services Mobile, LLC, are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. You agree that the exclusive venue for any such dispute shall be the state and federal courts located in St. Lucie County (Port St. Lucie), Florida, and you consent to the personal jurisdiction of those courts.

11. Indemnification

You agree to indemnify and hold Screening Services Mobile harmless from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Platform, your content, your services, or your violation of these Terms or any law.

12. Termination

We may suspend or terminate your access at any time for any reason, including violation of these Terms. You may stop using the Platform at any time. Provisions that by their nature should survive termination will survive.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by updating the date above. Your continued use of the Platform after changes take effect constitutes acceptance.
